Humanitarian Law, Human Rights and the Quest for Legality: What Choices in the Face of Imminent Danger?

In order to respond to a changing global security environment, Norwegian defense policy must be continually reappraised of the range and content of the legal norms relevant for the authorization of the use of force. To that end, this project proposes to analyze recent doctrinal developments in the co-application between human rights and humanitarian law, and to identify scenarios involving the realization of defense policy or troop deployments where a conflict of norms might arise. As such, the project has relevance for the security and defense policy debate in Norway, as well as for the development of legal regulations for the Norwegian armed forces, and for the further improvement of the legal training given to members of Norwegian military forces participating in international operations.
